The Freedom of Information Act 2000 allows for public access to information held by public authorities. The Act covers any recorded information that is held by a public authority in England, Wales and Northern Ireland. Scotland has its own Freedom of Information Act 2002.
Public authorities include government departments, local authorities, the NHS, state schools and police forces. However, the Act does not cover every organisation that receives public money, such as charities
The Act, however, does not give people access to their personal data and they should instead make a subject access request. However, recorded information can include documents, emails, photographs or video recordings.
Your business may not even be eligible to receive a Freedom of Information Act, however, it is important to know the distinction between it and a SAR. This highlights that your DPO needs to be informed in all areas of Data Protection so they can respond to requests from the public correctly.
