There is still confusion over what a company needs to do to be GDPR compliant – in fact even using the term, ‘Get GDPR compliant’ usually results in derision and cries of ‘snake oil’ from the GDPR community. So, it’s no surprise that companies that don’t understand GDPR and in many cases don’t really want to start the process choose to adopt a bare minimum approach to their GDPR compliance efforts.

In many cases, this seems to be based on the production of just the privacy statement, and even worse. Using a privacy statement they found on someone else’s website! Unfortunately, this is just not GDPR. GDPR is much more about how you behave as a business towards your customers and employees; about all the data you hold and how you process that data; and about the processes and systems you have in place to protect the privacy of your customers and employees. You can’t do that with just a privacy statement.

GDPR involves completing an audit of your data, your lawful basis for processing that data and looking at how you keep the data safe for as long as you store it. GDPR requires you to look at anywhere you share data and how any third parties also keep this data safe. Moreover, you need to communicate clearly with the people whose data you hold. You need to tell them why you need it, what you are going to do with it and how you are going to keep it safe. You also need to establish company policies and procedures to help you maintain data security and the privacy of any data you hold. This is just the basic stuff – there is more to do, but as you can see, this is much more than just a privacy statement on your website.
