When will GDPR enforcement actually start?

GDPR comes into force of 25th May 2018 – that seems pretty firm although I’m still willing to take bets on that date changing. However, what will that mean exactly? Will the small army of new enforcement officers march out of ICO HQ and start knocking on doors? Will you face a barrage of ICO requests? Probably not.

In a recent blog from the ICO there is a set of confusing statements that don’t help at all. The blog compares GDPR to Y2K and says that there is no reason to fear GDPR as this is an ongoing, evolutionary process and ICO won’t use a few example cases to scare people into compliance. However the blog clearly states that there is ‘no grace period’ and regulation will start of 25th May. There is the same list of action that needs to be taken to prepare for GDPR launch. So definitely no hint of flexibility or even recognition that the regulations are still being written and there is such a lot of work to do!

So, I am afraid the answer to the question, ’when will GDPR start?’ is still 25th May. You need to make sure that your GDPR preparations are complete – your systems, processes, documentation, contracts and consents, are all in place. Don’t risk being the example case – the army of GDPR inspectors might just be knocking on your door very soon!
