GDPR and PECR have some pretty strict rules about the use of text messaging for marketing purposes. Having a legal basis and being able to prove that you collected the data legitimately, including having a current privacy policy, is absolutely vital. Without this, you are risking enforcement action and fines. You also need to be able to demonstrate a reasonable data retention and erasure policy and that you have appropriate operational procedures in place to meet your obligations under GDPR. Oh, don’t forget your IT and other systems! You need to make sure these are up to scratch as well.

However, this is not all bad news! GDPR looks daunting but is not that difficult to implement. If you worked to the Data Protection Act then GDPR is more like a variation of these than a totally new set of regulations. More importantly the GDPR regulations are pretty clear. The principles are well defined [in most cases] and accountability is now obvious. This actually makes your life easier rather than more difficult. Having a clear set of guidelines helps you ensure that you are actually GDPR compliant. If you work according to the GDPR principles you should be safe. You should avoid malicious compensation claims and avoid ICO enforcement action. Don’t be tempted to download a privacy policy from any old website and amend it. This really won’t cut it. Take the time, do it properly and you’ll be fine.

So, GDPR is good. I’ll say it again! GDPR is good for companies that want to market their products and services to their customers, and potential customers, legitimately.
